At uPerform, we respect and protect the privacy of visitors to our website, www.uPerform.com (together with the other websites we own and control, the “uPerform Websites”), and our customers who use our on-demand services offered on the uPerform Websites (together with the uPerform Websites, the “Service”). This Privacy Policy (“Policy”) explains how we collect and use visitors’ and customers’ information, particularly personal information, as part of the Service. The information uPerform collects and uses is limited to the purpose for which customers engage uPerform and other purposes expressly described in this Policy. Any discussion of your use of the Service in this Policy is meant to include your visits and other interactions with the uPerform Websites, whether or not you are a user of uPerform’s on-demand services.
Service terms
1. PROCEDURE. The Statement of Work (“SOW”) shall define items to be furnished by Client to ANCILE including without limitation facilities, office space, services, personnel, supplies and equipment, which are necessary in order for ANCILE to develop and provide the Services. Unless specified in a SOW or a software license agreement, ANCILE is not responsible for the provision of any software, hardware or third party operating systems required or desirable in connection with the Services.
Terms of use
ANCILE Solutions, Inc. (“ANCILE” or “we”) provides content on this Web site (the “Site”) subject to the following terms and conditions (the “Terms”). ANCILE reserves the right to update the Terms at any time without notice. These Terms were last updated on January 5, 2011. By accessing and using this Site, you agree to these Terms.
Application terms
1. DEFINITIONS. Certain capitalized terms, not otherwise defined on the Cover Page, have the meanings set forth in this Section 1. 1.1 “Access Protocols” has the meaning set forth in Section 2.2. 1.2 “Access Term” has the meaning set forth in Section 2.1. 1.3 “Addendum” means any addendum to this Agreement executed by both Parties, if any, and may include, without limitation, ANCILE’s standard form of Professional Services Addendum.
Master subscription agreement
Effective as of February 06, 2019. THIS AGREEMENT CONSTITUTES A BINDING CONTRACT BETWEEN CUSTOMER AND ANCILE AND GOVERNS CUSTOMER’S USE OF AND ACCESS TO THE SERVICES BY CUSTOMER AND ITS USERS WHETHER IN CONNECTION WITH A PAID OR FREE TRIAL SUBSCRIPTION TO THE SERVICES. By accepting this Agreement, either by accessing or using a Service, or authorizing or permitting any User to access or use a Service, Customer agrees to be bound by this Agreement. If Customer is entering into this Agreement on behalf of a company, organization or another legal entity (an “Entity”), Customer is agreeing to this Agreement for that Entity and representing to ANCILE that Customer has the authority to bind such Entity and its Affiliates to this Agreement, in which case “Customer,” “Customer’s” or a related capitalized term herein shall refer to such Entity and its Affiliates. If Customer does not have such authority, or if Customer does not agree with this Agreement, Customer must not accept this Agreement and may not use any of the Services.
